A lawsuit between Engold Mines Ltd. and its former president, featuring allegations of wrongful dismissal and fraud, looks to be headed for a full trial in the Supreme Court of British Columbia. On Tuesday, Feb. 13, a judge determined that parts of the case were unsuitable for a summary trial. That means that the matter will go to a full three-week hearing in November, 2018.
The ruling is part of a wrongful dismissal lawsuit filed by Irvin Eisler, 85, who was the president of Engold predecessor GWR Resources Inc. The suit, filed in Vernon, seeks damages stemming from Mr. Eisler's May 23, 2011, firing. He claims that the company fired him for no good reason, with the board falsely accusing him of stealing $1-million.
The case has become a somewhat complex legal affair, with the two sides filing many documents in the court registry. Among them is a counterclaim from Engold, in which the company accused Mr. Eisler of fraud. Engold said that he approved payments to his personal companies for work that was never performed. According to the counterclaim, Mr. Eisler's companies received $3.7-million over a seven-year period, at least some of which Mr. Eisler and his wife used to buy a piece of land in Armstrong, B.C.
