Convicted - Patrick Rosko, President and Director of Marfred Minerals Ltd.

Location - Kirkland Lake, Ontario

Description of Offence - Mine production without a filed certified Closure Plan.

Date of Offence - On or about July 15, 2015

Date of Conviction - Justice of the Peace Jean-Marie Blier accepted Patrick Rosko's guilty plea and fined him on November 13, 2018, in the Ontario Court of Justice in Kirkland Lake, Ontario.

Penalty Imposed - Patrick Rosko, President and Director of Marfred Minerals Ltd., was fined $5,000 plus a victim surcharge (VFS) of $1,250. Mr. Rosko was given one year to pay the fine.

Background -

On July 15, 2015, staff from the Ministry of Energy, Northern Development and Mines attended the Ryan Lake Mine and observed Patrick Rosko, of Marfred Minerals Ltd. occupying the mill facility and operating a barite milling business. Specifically, Mr. Rosko was engaged in the activities of grinding, crushing and sifting barite to prepare it for sale to smelter facilities.

The barite milling activities were a form of mine production, as that term is defined in the Mining Act, and on July 15, 2015, there was no filed, certified closure plan with respect to the mine production activities at the mill facility.

Patrick Rosko, as President and Director of Marfred Minerals Ltd., committed an offence under section 167(1) of the Mining Act. Mr. Rosko pleaded guilty to the offence.

Justice of the Peace Jean-Marie Blier accepted Mr. Rosko's guilty plea and fined him on November 13, 2017, in the Ontario Court of Justice in Kirkland Lake, Ontario.
